Tom advises a wide range of clients – from small businesses to multi-national corporations across a number of different industries – on international trade compliance issues, including U.S. export controls, trade sanctions, and import regulations.
Tom assists clients in developing trade compliance policies, procedures and manuals tailored to their business and provides strategic guidance on structuring operations to ensure compliance with applicable requirements while minimizing costs and business interruption. Tom also provides training to clients on compliance requirements relevant to their businesses.
Tom has conducted internal export compliance reviews in the context of both voluntary self-disclosures and corporate audits. Tom has prepared voluntary disclosures to the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC), U.S. Department of Commerce’s Bureau of Industry and Security (BIS), and the U.S. Department of State’s Directorate of Defense Trade Controls (DDTC) which were resolved with the issuance of warning letters and without the imposition of criminal civil penalties.
Leveraging his analytical background, Tom enjoys conducting import compliance reviews and risk assessments, including post-entry audits, and he provides guidance, training and recommendations specifically tailored to clients’ needs and import activity, with an emphasis on minimizing risk and import duties. Tom has overseen and prepared a number of prior disclosures relating to complex valuation issues, NAFTA and other free trade agreements, HTSUS Chapter 98, anti-dumping and countervailing duties, and tariff classification, including several large prior disclosures requiring statistical sample reviews.
Earlier in his career, Tom practiced complex commercial litigation, representing numerous international clients in a broad range of matters, including antitrust, securities, products liability, and contractual disputes. Tom earned his J.D. from Southern Methodist University Dedman School of Law in 2004, where he served as the Managing Editor of the SMU Science and Technology Law Review, and his B.A. in Mathematical Economic Analysis from Rice University in 2001.
